These Terms of Service set out the agreement between you and ABILYZ FERNANDEZ LLC for the use of this website and for the garden services described on it. Please read them before you send an inquiry or book any work. By browsing the site, submitting the contact form, or engaging the company, you accept these terms together with the Privacy Policy published on this website.
ABILYZ FERNANDEZ LLC is a limited liability company with its principal place of business at 640 Iris Rd, Casselberry - 32707-5039, United States (US). The company operates an iris cutting shed and a seasonal garden design and bloom care practice in Central Florida. The terms below reflect how that small operation actually works: honest scope, counted stems, written records, and clear communication when weather or plants do not cooperate.
If you do not agree with these terms, please do not use the website or book a service. You are welcome to call +19862405119 to discuss any part of the terms before deciding.
1. Agreement to these terms
These Terms of Service form a binding agreement between you and ABILYZ FERNANDEZ LLC. They apply every time you visit the website, submit a form, send an email, call the shed, or accept a quote for garden work. Where a signed service agreement or a written quote accepted by email contains terms that differ from these terms, the more specific document governs the particular job to the extent of the difference.
If you use the site on behalf of a household, a family trust, or a property you manage, you confirm that you are authorized to accept these terms for that property. If you are not authorized, please stop using the site and ask the responsible person to review the terms.
We may revise these terms from time to time as described later. The version published on this page at the time of your visit is the version that applies to that visit. For a service agreement already in progress, the terms in force when the agreement was accepted continue to apply unless we both agree in writing to a change.
2. About the company and the shed
ABILYZ FERNANDEZ LLC is a limited liability company based at 640 Iris Rd, Casselberry - 32707-5039, United States (US). The business runs an iris cutting shed that supplies a seasonal garden design and bloom care practice serving Central Florida yards. Work is performed by the company and by people the company engages directly, and it is carried out under the operating rhythm stated on the site: cut at dawn, condition by noon, count every stem.
The shed is a working space, not a retail storefront. Visits are by appointment so that the bench is not disturbed during conditioning and so that client records can be discussed privately. If you arrive without an appointment, we will help if we can, but we may ask you to return at a scheduled time.
The website describes the services and the company in good faith. It is not a catalog of guaranteed outcomes, because plants respond to weather, soil, and care in ways no company can fully control. Where a page describes what a service typically includes, the accepted quote for your job sets the exact scope.
3. Eligibility and authority
The website and the services are intended for adults who can enter into a binding contract. By submitting an inquiry or booking a service, you confirm that you are at least eighteen years old or that you are acting with the consent of a parent or legal guardian who accepts these terms on your behalf.
If you contact the shed about a property you do not own, such as a rental, a property in a trust, or a yard you manage for someone else, you confirm that you have permission from the owner or the responsible manager to arrange the work described in your inquiry. We may ask for written confirmation of that permission before starting work, particularly where the work involves dividing plants, removing established shrubs, or altering irrigation.
We may decline an inquiry or end a service relationship if we reasonably believe that the person making the request lacks authority, if the request is unlawful, or if continuing would create a safety risk for our staff or for the property.
4. Website use and permitted conduct
You may read, print, and share pages from this website for your own non commercial use and for the purpose of deciding whether to engage the company. You may not copy large portions of the site into another website, present the content as your own, or use the content to train a commercial model without written permission from ABILYZ FERNANDEZ LLC.
You agree not to interfere with the operation of the site, not to attempt to gain access to systems or records that are not public, not to submit malicious code, and not to use the contact form to send unsolicited advertising, chain messages, or content that is unlawful, threatening, or abusive. Automated scraping that places an unreasonable load on the site is not permitted.
We may suspend access to the site, remove content, or block a source of abusive traffic if we believe it is necessary to protect the site, our clients, or the public. We will try to act proportionately and to explain the reason if you contact us.
5. Inquiries and quotations
An inquiry sent through the contact form or by email is not a booking. It is the start of a conversation. We will read the message, ask any clarifying questions, and, where the job looks like a fit, arrange a survey visit. A survey visit lets us see the light, the soil, the drainage, and the condition of the beds before we quote.
A written quotation describes the scope, the price, the estimated number of visits, and any assumptions on which the price depends. A quotation is valid for thirty days unless it states a different period, because plant stock prices and supplier availability change through the season. A quotation becomes a booking only when you accept it in writing and, where the job requires it, pay any deposit described in the quotation.
If the conditions at the property differ materially from what the survey showed, such as undisclosed irrigation problems, inaccessible beds, or additional planting areas, we will explain the difference and issue a revised quotation before doing the additional work.
6. Booking and service agreements
A booking confirms a date, a scope, and a price. For one time work such as a design survey, a planting day, a tidy-up, or an event order, the booking covers that single job. For recurring work such as weekly bloom maintenance, the booking sets up a route with a stated visit day and a stated notice period for changes.
We keep a written record of each visit and send a short note afterward. The record is part of the service, and it is how we can explain what changed in a bed months after the work was done. If a client believes the record is inaccurate, we will review it together and correct it where the evidence supports a correction.
Either party may end a recurring service by giving the notice stated in the quotation, or fourteen days where no period is stated. Ending a recurring service does not cancel an unpaid invoice for work already performed, and it does not automatically cancel a separate event order.
7. Scope of the six services
Seasonal garden design produces a planting plan with a calendar, spacing notes, and an honest assessment of what will thrive on the site. It includes the survey, the plan, and a review visit. It does not guarantee that every plant named in the plan will be available at the moment you choose to plant, and it does not include the cost of the plants unless the quotation says so.
Iris and perennial care includes division, rhizome lifting, cleanup, pruning, mulching, and staking as described in the quotation. Weekly bloom maintenance includes deadheading, watering checks, staking, seasonal container swaps, and the written visit note. Container garden styling includes the design, soil, planting, and a seasonal swap schedule for the containers named in the quotation. Yard tidy-ups cover the clearing, edging, cut back, and removal of debris described in the quotation. Event blooms cover the cut, conditioning, and delivery of the stems specified in the order confirmation.
Anything not described in the quotation is outside the scope. Examples include hardscape construction, irrigation repair beyond a simple adjustment, tree removal, pest treatment requiring a licensed applicator, and work on a neighboring property. If a job reveals that one of these is needed, we will tell you and, where appropriate, refer you to a suitably qualified provider.
8. Client responsibilities
To do the work well, we need accurate information and reasonable access. Please tell us about buried utilities, septic lines, drainage fields, irrigation heads, and any area where digging should be avoided. If you do not know the location of a private utility line, tell us and we will agree on a safe approach before any digging begins.
Please also tell us about pets, gates, alarms, and any condition on the property that could affect safety. If a pet is protective of the yard, arrange for it to be indoors or secured on the day of the visit. If a sprinkler system is on a timer, confirm the schedule so that planting and watering do not conflict.
Where a service depends on water being available, please make sure an outdoor tap is accessible. Where a service depends on power for a tool, please make sure an outdoor outlet is available. If neither is possible, tell us before the visit so we can bring a battery tool or adjust the plan.
9. Property access and safety
We enter a property only for the purpose described in the booking and only on the agreed date or a rescheduled date. We do not enter a dwelling, a locked shed, or a vehicle unless separate access has been agreed for that visit. Access codes are used only for the service and are handled as described in the Privacy Policy.
Our staff may stop work if conditions are unsafe, for example during lightning, high wind, flooding, or extreme heat. Safety decisions are not a breach of the agreement. Where work is stopped for safety, we will discuss a replacement date and will not charge for time that could not be used.
Please keep the work area reasonably clear of hazards such as exposed wires, broken glass, or loose steps. If a hazard is present and cannot be avoided, we will point it out and may ask you to arrange for it to be made safe before the visit continues.
10. Weather, seasons, and living plants
Gardens are living systems, and no company can promise a precise bloom date, a precise number of flowers, or a precise color match. We work from a real bed with real weather. Where a bloom cycle runs early or late, we will tell you as soon as we see it and offer the closest honest alternative from the same bed or from a trusted local supplier.
Heat, cold, drought, flooding, pests, and disease can affect plants after a visit. We use reasonable horticultural practice, but we cannot guarantee that a plant will survive a condition outside our control. Where a plant we installed fails within a short stated period and the failure is not caused by weather, neglect, or damage, we will discuss a replacement on the terms in the quotation.
Seasonal timing is part of the service. A design that fits the spring will not fit the same way in fall, and a weekly route in summer may need a different rhythm in the cooler months. We will explain any seasonal adjustment before it is made.
11. Pricing, invoices, and payment
Prices are stated in United States dollars. A quotation states whether the price is fixed for the described scope or estimated on the basis of time and materials. Where a quotation is an estimate, we will tell you before the estimate is likely to be exceeded and will not continue without your agreement.
Invoices are sent after a visit or at the milestones stated in the quotation. Payment terms are stated on the invoice, usually fourteen days from the invoice date unless a different period is agreed in writing. Late payment may attract a reasonable administrative charge where the law allows and where the invoice states it.
Where a deposit is required for plant stock, event blooms, or a long design project, the deposit secures the materials and the date. Deposit terms, including any part that becomes non refundable once stock is ordered, are stated in the quotation. We do not store full card numbers, and card payments are handled by a payment processor as described in the Privacy Policy.
12. Cancellation, rescheduling, and no shows
We understand that plans change. Please give as much notice as you can when you need to reschedule a visit. For a single visit, twenty four hours of notice lets us move the slot without a charge. For an event order, the notice period is stated in the order confirmation because cut stems and conditioning time are committed in advance.
If we need to reschedule because of weather, staff illness, or an equipment problem, we will contact you as soon as we know and offer the next available date. We do not charge for a visit that we cancel or move for our own reasons.
If a visit cannot proceed because access was not available and we were not told in advance, we may charge a reasonable trip fee, explained on the invoice. Recurring clients who repeatedly miss scheduled access may have the route adjusted or ended after a conversation about what will work.
13. Cut blooms and event orders
Event blooms are cut from the bed and conditioned at the bench, then delivered in the form agreed in the order confirmation. The order confirmation states the stems, the count, the delivery window, and the price. Because cut stems are perishable, an event order cannot be returned once it has been delivered and accepted.
Where the bed cannot supply the agreed stems on the date, we will tell you before the delivery and offer the closest substitute from the same season or an adjustment to the order. We will not substitute without your agreement on a color sensitive order.
Once blooms are delivered, care of the vase or bundle passes to the recipient. We are happy to explain conditioning and vase care at delivery, but we cannot control room temperature, water changes, or handling after the handover. If a delivery arrives damaged, tell us within twenty four hours and we will review it with you.
14. Intellectual property
The text, layout, visual design, photographs, and code of this website belong to ABILYZ FERNANDEZ LLC and are protected by applicable copyright and other laws. The name ABILYZ FERNANDEZ LLC and the shed branding are identifiers of the company. You may not use them in a way that suggests sponsorship or endorsement without written permission.
A garden design plan prepared for a client is licensed to that client for use at the property named in the quotation. The client may plant the plan and share it with a contractor working at the same property. The client may not resell the plan, publish it as a template, or use it at a different property without written permission.
Photographs taken by the company of a client property remain part of the client record and are not published without separate written agreement, as described in the Privacy Policy. Client supplied materials, such as a survey or a planting list, remain the property of the client and are used only for the agreed job.
15. Disclaimers and limitation of liability
The website is provided as it is. We work to keep the information accurate and the site available, but we do not promise that every page will be free of errors or that the site will never be interrupted. If you rely on a detail from the website for an important decision, confirm it with the shed directly.
To the fullest extent permitted by law, ABILYZ FERNANDEZ LLC is not liable for indirect, incidental, special, or consequential loss arising from use of the website or from garden work, including lost profits, lost enjoyment, or loss of a plant caused by weather, neglect, or a condition outside our control. Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.
Where liability is not excluded, the total liability of the company for a claim connected with a service is limited to the amount paid for that service, except where the law provides otherwise. This limit reflects the scale of the company and the practical nature of the work.
16. Indemnity
You agree to indemnify ABILYZ FERNANDEZ LLC against reasonable losses, costs, and expenses arising from a claim that results from your breach of these terms, from information you supplied that was inaccurate, from your failure to disclose a hazard on the property, or from your use of the website in a way that is unlawful or harmful to another person.
This indemnity does not apply to the extent that the loss is caused by the company itself, and it does not require you to cover a claim that arises from our own negligence or willful misconduct. If a claim is made, we will tell you promptly and give you a reasonable opportunity to participate in the response.
17. Governing law and disputes
These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law rules. The parties agree to attempt to resolve a dispute through good faith discussion before starting formal proceedings. If a discussion does not resolve the matter, the dispute may be brought in a court of competent jurisdiction located in Florida.
Before formal steps, please write to ABILYZ FERNANDEZ LLC at 640 Iris Rd, Casselberry - 32707-5039, United States (US) with a clear description of the concern and the outcome you are seeking. We will review it and respond in writing. Many matters can be settled at this stage with a revised visit, a replacement, or a credit.
If any part of these terms is found to be invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the remaining terms will continue in effect.
18. Changes to these terms
We may update these terms when the services change, when a new legal requirement applies, or when the way we work needs to be described more clearly. The updated version is published on this page with a new date. We encourage you to review the page when you return to the site.
If a change materially affects a service agreement already in progress, we will take reasonable steps to tell active clients before the change takes effect. Continuing to use the website after a change is published means that you accept the updated terms for future visits and future bookings.
A failure by the company to enforce a particular term on one occasion does not waive the right to enforce it later. A waiver is effective only when it is given in writing by an authorized representative of the company.
